Tier 5 YMS to Unmarried Partner Visa

Hello everyone,

I am just looking for some advice on my situation please.

I'm am a 22 year old Canadian currently living in the UK on a Tier 5 YMS visa. I moved over to the UK in December 2014 which means my visa runs out mid December 2016. I have been employed at my current employer since the beginning of January 2015 and now work as a Project Engineer. I know that Project Engineer is on the list of jobs that can be sponsored for under the Tier 2 General visa however, my employer has emailed the agency who make the SOC codes and they have said that my job description doesn't completely match the Project Engineer job description as described by the SOC code but does match to some extent. They have let us know that we can apply for it and the government might approve it but it is a risk. I have also been in a relationship with my partner (who is 22) since December 2011 which is part of why I moved over to the UK in December 2014. When I moved in December 2014, my registered address was my partner's parents’ house which they own. My partner was renting a student flat with friends while still receiving bank statements, phone bills, pay slips, NHS prescriptions and is also on the electoral roll for her parents’ house. She was obviously on a tenancy agreement for the student flat but was spending a lot of her time with me at her parents’ house. In June 2015, the tenancy was done at her student flat and she was back with me at her parents’ house until end of September 2015 when she was already committed to a tenancy agreement for a student flat until end of July 2016 still spending a lot of her time at her parents house. During this time, I was still registered at her parents address receiving phone bills, bank statements, pay slips, Home office letters, NHS prescriptions etc... as was my partner. From August 2016 until December 2016 (end of), my partner doesn't have another address registered under her name so we are both at her parents’ house with the above proof. We have also both separately opened a Help-to-buy ISA account to help us purchase our first home should I get a visa. We have also been looking to rent houses as an alternative and have proof of that with emails from estate agents. She was never not registered at her parents with me and can also prove that she was receiving all the above at the same address as me. We have been in a genuine relationship since December 2011 and have loads of proof of that (photos together, messages, photos with me and her family, and also flight details together). I can also show my old passport and so can she of stamps when we visited eachother quite often. I am looking for advice on what to do to remain in the UK because my intention is to live and work in the UK for the rest of my life and would not know what to do should I not be able to stay...

I would appreciate some help very much.

Nationality of partner?
Is partner working?
Any plan to marry?

You can't be pre-selected for a T2 job!
That makes a mockery of RLMT (& puts sponsor's prestigious license at risk).

My apologies noajthan.

My partner is British and has lived in the UK her entire life.

She is currently doing a PhD and has a large bursary so she is getting paid to do it.

Eventually at some point there is but weren't planning to just yet.

Are you saying that because I am a project engineer at my current employer, they wouldn't be able to issue a COS for the SOC code of project engineer?

No and yes, jobs first need to offered to UK/EU candidates first and if none at are found then the red flags are waved especially if the current incumbent whio is/was on another visa is offered the role.

Its just that the easier to read the more replies you may get.

British partner means EU route is not an option if based in UK.

For you to get the job you're doing the RLMT would have to be really rigorous.
It has to give every young ambitious and go-getting PE in UK and Europe the chance to take that job before you.

Many thanks for your replies.

I have contacted Immigration Lawyers as well to get their opinion and they have let me know that in my situation, they would go for the Unmarried Partner Visa FLR(M). Do you reckon it's worth having a chat to them in person to explain everything?

An unmarried partner visa on FLR(M) will only potentially succeed if you have documentary evidence of living 'in a relationship akin to marriage' for a minimum of 24 months. This is a non negotiable point for UPV.
