As you applied for ILR under long residence your wife's only option is to apply for FLR(M) which will re-set her immigration clock to zero, putting her on a new 5 year route to settlement.

Is your wife working?

In which case you will be unable to show a minimum income of £18.600 p.a which is mandatory for FLR(M).

How are you supporting yourselves financially if you are also unemployed?

Is there any other option. My family/brothers were supporting me during 10 years.

They can't support you financially for your wife's FLR(M) application as 3rd party support is not permitted.

FLR(FP) if you don't meet the financial requirement.

Your wife's only option may be to apply for FLR(FP) Partner route. This will be a 10 year route to permanent settlement.

If/when you are able to meet the minimum income requirement, you could vary it to FLR(M).

If your wife has a valid visa until 2018 there is no time limit to switch to FLR (M) or FLR (FP) .
I contacted home office to find out answer for this question and they told me that it is advisable to switch as soon as possible but failure to switch immediately would not be considered a breach of rules as she would still be you wife and would have a valid visa.
You can wait for another year or so and prepare to switch meanwhile

Hi,
Googleit is absolutely correct as I am in the same situation. My wife got LR long residence in March 2016 from Tier 1 Entr and I was a dependant on her and up till now I am still a dependant on her and I have travel to Africa twice and no issue at all when coming back to UK.
My advice is as you are not in position to meet the requirements for spouse visa and your wife visa still valid till 2018, don't bother to switch her visa as visa will always valid except home send you a curtailment letter which they will not do in this case because you already paid for that visa.

Kind regards

I got ILR, advise for wife

Post by Tani123 » Thu Dec 15, 2016 7:30 am

Dear Gurus
First of all thank you very much for help regarding my 10 year long residence successful ILR.

My wife is in the UK from the last 16 months as Tier 4 dependent. Currently can NOT fulfill £18600 condition. Please guide which application from I need to fill for her. While being as Tier 4 dependent she completed as full time student MSc with distinction in Sep 2015/16 session in British university.
Please guide which application form need to be filled for her to become SET-LR dependent.

Many thanks in advance.
