Curtailment on resigning from job

Post by supergood » Fri Jun 03, 2016 5:17 pm

Dear Respected Gurus,

I am in Tier 2 ICT Long Term valid until Aug-2018. My employer has initiated "transfer" and i have been instructed to leave on 9-June. Whereas i am intending to stay for 2 more months legally in UK to complete my son's school, settle my stuff, and then leave by 5-August.

1. Looks like only option for me is to "resign" as my assignment letter states 2 months notice period in case of resignation or termination. But my employer is not agreeing to it, and insisting me to resign only from my home country. Can i resign in UK legally even if i am in Tier 2 ICT LT?

2. Is my employer obliged to pay me during the 2 months notice period? They simply say NO. What should i do?

3. Will i get a curtailment letter from UKVI, detailing my legally allowed stay after my resignation?

Thanks a lot in advance.
