Recurrent RoR Issue!

I am written before about my eea wife threat of divorce on this forum,unfortunately,she's going ahead with it. We've been together for over 4years, with a 2years old child and I am sure she will not support my ROR application however,she has acquired PR and her application is under process.I have proof of her exercise of treaty right for 5years and she's still working.Do I still need to be reliant her for Ror or can i go for it alone if the Divorce is finalised?Thanks

You need evidence to gain ROR so start gathering it now.
If wife won't play nicely then section 40, UK Borders Act 2007 is your friend.

The rest depends on timing.
If you drag divorce out for another year you may even acquire PR.

Got p60 and sa100 for 5years (may 2011 to 2016) already and might not be able to get any further document .she's sent me out of the house already and i just trying to sort out visit to see my son.

my case is similar to this" http://www.immigrationboards.com/eea-ro ... 9.html"and It ended well.might take a cue.The only possible difference is that she acquired and would possibly recieve document certifying permanent Resident before 5years of marriage which is less than a year anyway.

Update!!!! I am writing for seek further clarification on above matter.Since my last post,my ex has received her PR card and she offered to give me the home office letter that accompIined the card as her proof of Pr if our divorce has not been finalized by the time we clock 5years of marriage(I have still not seen any divorce papers despite her threat)I am hoping the gurus can assist in clarifying if that will be enough to proof her settled status with my application.Thanks

Two ways you can deal with this.

1, Firstly allow your decree absolute to come out and I do pray it comes out before your RC expire.You can use it to apply for PR as you said you've been together for 4yrs. Otherwise it will be difficult to apply for anything after your RC expired as an ex spouse of EU national.

2, With her treaty right that you have is enough for you to apply in your own right for PR as you have confirm she's got PR which she doesn't have to work till your divorce date. Also I think in the 2014 application version there was a section that ask you to tick If your sponsor has acquired PR,ref number and having child together which in this case I strongly think will help your application. You don't need her ID to apply for PR in your own right as you may be aware all you need is the treaty right of her that you have kept, you just carry on working and when you RC nearly expire apply for PR with divorce cert,ex treaty right,yours present employment pay slips.

NOTE, IF YOUR DIVORCE HAVEN'T FINALISED AND YOU PRESENT ANY APPLICATION IT WILL BE SENT BACK AS YOU HAVE NOT LEGALLY DIVORCE. IF YOU CAN GET HER PR REFERENCE NUMBER WITH LETTER SHE GAVE YOU WITH SOME GOOD RELATIONSHIP PAPERWORK THAT WILL BE GREAT. GOOD LUCK.

Thanks wise.its Great to know I have options.However,i am convinced the Divorce will not come through before our marriage clock 5 years which is around the corner and my RC will not be expiring anytime soon.just trying to tie up loose ends.My ex is unpredictable and erratic.

Does anyone have the 2014 version of PR form please?
