You can apply for AR however they might refuse it, because main documents is missing. However from the date you got the refusal letter you have 14 calendar days for AR, in this you can either apply for AR or fresh application. However if your new documents will take more time then to be on safe side apply for AR, by this you will additional 28 days and in these 28 days you can apply for fresh application with out waiting for AR decision. In cover letter mention that about previous application number and all the documents which home office already got.

After AR decision you will again have 14 calendar days to apply for fresh application, you can go for JR but if it gets refused then you will become over stayer, so it is better to go for fresh application. Like Zimba suggested you can add those documents plus you can ask the accountant to make an additional note.

Refusal reason
Paragraph 46-SD (b)(4) if the applicant has invested by the way of share capital the business account must show the shareholders , the amount and value of the shares ( on the date of purchase ) in the applicant's name as it appears on his accounts, if the value of the applicants's share is not shown in the accounts then a copy of the company 's register of members must be provided".
From the evidence you supplied , we are not satisfied that points can be awarded in respect of these investments because the accounts do not show share capital bought in your name and you didn't provide the company's register of member as specified below in the immigration rules.
We there for been unable to award points for attributes.

They refused for same reason - my name was not mentioned as share holder in annual accounts and I did not submit the members list
I did via share capital and gave share certificate, personal account, business accounts and unaudited accounts to demonstrate my investment of 50k

HO said in refusal letter
As a result you have demonstrated that you have invested no money into one or more UK businesses.

In my case, I got refused in AR also and I am going for JR (since I have only this option)
I sent pre action letter and HO asked me extra time to respond

We are looking for grounds to succeed the case

Please could you tell me why you don't have option after AR refusal for fresh application as you said you are going for JR
More over could you post exact wording for your AR refusal

My application was also refused because I didnot attached DL and bank statement, further they didnot check the full info which I submitted for employees. I already applied for AR on 26th Sept and now in next week applying for fresh application. If you check below link you will see my thread with full updated

Here you will also see the documents which I am attaching. I would suggest you to attach all the documents again and upto date, like for employment till now. However some of documents were already held by home office such as your degree, passport, BRP, marriage certificate or child birth certificate (if you are and have). So you cannt submit these with fresh application, but you can give refernce of last application that home office already got and awarded you points. Another guy on this forum was in similar situation and he applied for fresh application while he was in time line of AR, as soon as he applied for fresh application his AR automatically got refused, however he got his initial documents back except passports. What he did is, as soon as he got the documents back he sent them again to home office with his fresh application reference number.

I am also planing to do same and you can do this, if you want to. I hope this will help you

Since I applied for extension after expiry of visa, I have only JR option

Pre Action letter
Before going to court, we send a letter to HO by asking them to issue visa otherwise we will go to court on this this grounds
HO can maintain their decision in this stage or agree to reprocess/issue visa

If you have fresh application option, better to go with it
going to court will eat your money

Please follow only whatever they mention in rules, no logical arguments or no smart decision
They have a checklist, if anything missing (minor or major issue) they will refuse your visa
This is a closed system and will not work with sense, only check list

So awan you suggest that we should apply for AR mean while prepare documents and apply for fresh application without waiting for AR decision and mention in the new application that we are widthrawing AR and applying for new application .

If you are missing main document then defending AR is useless,if you can get all the documents with in AR time that is better other wise in order to gain time apply for it. When you will submit the new application, your AR will be automatically withdrawn.

Thnxx for your help I'm unable to understand that when that guys you are taking about applied for AR normally they send you document after AR refusal so how did he make application B4 AR decision .
You mean to say home office returned his document b4 AR secession . And he applied for fresh application

For fresh application after AR (if it is negative) when I will submit new application the employ I will claim points for
Will I be claiming points for the same employees for same period or can I claim points for existing employees which are on pay role now
Like my visa was expiring on 21 June 2016
My application got refused on 3 of October 2016
So after AR would I be able to claim points for the employ working later or she'll I stick to claim points for same employee's information as I have done in first application submitted

Would you like to help me in writing AR please as explained earlier that we accountant didn't add notes at one place and we didn't provide copy of member's list but on annul account on page 7 and 11 it does say that allocated shares are fully paid the value of the shares and on page 11 it says that I'm director and 100% share holder and that the end date but unfortunelty there is no issue date on accounts of shares so if the rest of the information is there although not at one place but at least it is there on different pages .
Whould you guys like to give opinion what should I write and what are the chance in AR having said that they would have ask for additional documents and as most of the information was there on accounts as well.
Please if you kindly help me giving some idea to write AR

I dont think AR would help you, because you are missing main document. This is just to gain extra 28 days to be legal in UK, so just mention that you submitted all the documents and also ask them to allow you to submit the missing one.
In my case I didnot put much info in AR because I also missed main document.
