SET(O) -entrepreneur. Absence questions

Post by seasky » Tue Oct 11, 2016 11:30 am

<I am cross posting to here as did not get a single reply (OCT 2) on the ILR forum even after bumping the thread (OCT 5) this is an ongoing issue with ILR thread as T1-E has quite specific ILR criteria>

In section 6 you have to list date left/returned and reason for absence.

It then says evidence of all work related absences are required for different visa types but NOT T1-E

But then in section 6.3 it asks for "what evidence has been provided to support the reasons for all absences from the UK". It is not clear if that relates to T1-E

I am now counting my trips, but it is approximately 70 trips outside the UK over 5 years. vast majority business trips and a few leisure trips (a good few overnight trips to Europe effectively 0 days outside UK as I understand the day leaving/returning are considered in UK). I run my own company what evidence do I need to show? Will a general letter written and signed by a director (myself?) explaining why I travel cover this? Explain it in my covering letter?

Lastly in the sticky there are templates for absences, as mentioned above they only ask for date left/returned and reason for absence. Would a more detailed list incl. days abroad calculated, airline etc be welcomed by HO?

SET(O) form is used by most Tiers and it is quite a generic form. However a high skilled migrant on Tier 1E applicant does NOT need to provide ANY evidence for their absences. You simply need to fill up that table, declaring all absences and the dates and simply provide a reason for your absence (work, holiday, etc) No evidence is required !

FYI HO has access to all the border information anyway. You can even get all your immigration history data including the departures and arrivals to/from the UK via a Subject Access Request (SAR) for a fee
(see https://www.gov.uk/government/publicati ... mmigration)

So I just leave section 6.3 unanswered? Write in "not required by t1- entrepreneur"

I ordered my SAR, it took 180 days. Out of aprox 70 trips they attached 1 (one!) of them. I am a bit at loss.... (and trying hard to resurrect all my travel accurately including a few entry stamps that are ineligible)
