URGENT HELP WITH EXTENSION - Tier 2

Hello all,

So, I am due to renew my Tier 2 Visa and we (HR and me) ended up in a dangerous corner.

The original visa is: Tier 2 (General - New hires - restricted), so I believe the extension should be again restricted right?

This is what we are not 100% sure. The person responsible for the VISA said she allocated or already asked some sort of pre-authorisation or even pre-allocation (not sure if this exists) at beginning of this year, because a few years ago they had some issues with the number of visas.

So, I can see in the SMS (the portal to create the CoS) they have 3 remaining Tier 2 (General) - however, we are not sure if the number is just related to the max Tier 2 visas they can issue OR if this is some sort of allocation in that monthly limit for restricted CoS.

Another thing: I read in this forum somewhere that, when extending, the CoS doesn't need to be restricted again (only when you are applying from outside). Is this correct?

I am a Brazilian National, my job code is not under the shortage list and I just want to extend the Tier 2 general that I have.

you need a unrestricted cos.
what you are looking at sms, is your company current allocations. This means they can issue 3 people cos till 4 april 2017 when this allocation will expire.
now all u need to do is, ask them to issue u a cos, make sure ur salary is at experienced level, fill in the form.

Another question:

For the extension, I found this:

38.25 When you assign a CoS to extend a migrant’s leave in the same tier and category, the start date on the CoS should be the day after their current leave expires.

This is kind of preventing me to submit an earlier extension...since my data is the following:

Start date CoS: 01 February 2014
End date CoS: 29 January 2017
End date VISA: 28 February 2017

So, I am planning to apply THIS WEEK with a start date for the extension around 09/01/2017. Will that be a problem?

I understand you can't apply before 3 months of the Start Date of the Cos AND you have 3 months to apply for the visa when the CoS is submitted, however - earlier extensions are not so clear.

Any experience?

I want to have my VISA before the Holidays, since almost everyone stops working and I believe the same happens with the Immigration office.

thats fine. U can apply as early as u want. 3 months, 6 months, 1 year etc.. no problem at all.

I didnt go for admin review but made a fresh new application within 14 days, Did the biometric but recieved a letter from ADmin review department that my rview period expired and they aware i submit new application.

They also five me 7 days to take legal action and say what ground i wish to stay and many more.

My question is if i made a new application and they acepted it then why should i go for Admin Reviw and whats the point of this letter??
Is this a general letter they issued everyone after admin review period expired ?

Very confusting..frustrating and scary. Anyone please kindly clear the issue.
