EEA family member application if I marry

Post by Mayte » Fri Oct 14, 2016 2:38 pm

Hi, i am. EEA member and living here since 2008 but not exercising treaty rights for 5 continuous years. I am self employed since March 2013 (also employeed from sept 2015 to June 2016) and getting working tax credits till May 2016 when I stopped them because I was in a relationship, but i am still self employed. I also have 2 british children (one is naturalised, the other by birth). The father of my children (now my partner) has PR since summer 2015. My questions are.

1. If I marry my partner now, am I granted with PR, as he would be my sponsor? In that case, would I have to wait one extra year to apply for British citizenship?
2. Do my working years (march 2016-May 2016) count towards my 5 years exercising treatry rights although I was getting tax credits? Not sure if these benefits count as I am not funancially independent.

Can anyone suggest how I can apply/get PR at this point? I have been on jobseekers allowance for more than 6 months, never been a student, or have private health company. I've proof that i have progressed in life, got few temporal jobs, recently qualified as teacher through an NVQ course, settle down , have children and a couple that financialy supports me. Any help here, please? Can I apply as a family member of my partner
Thanks a lot!
