ILR for Dependents

Post by hgodhrawala » Sat Oct 15, 2016 4:59 pm

Hello Everyone.
Need some information and advice.
I would be applying for ILR next year under the 10 year long term settlement category.
My wife has completed 8 years as a dependent with me and my 2 children have completed 5 and 2 years respectively.
CAN THEY APPLY AT THE SAME TIME AS I WILL NEXT YEAR ALONG WITH MY APPLICATION?

Thank you

No, they cannot, Set(LR) does not permit dependents to apply with you. They will have to apply to switch for FLR(M) and meet all the requirements.

What is your current visa category?

My current category is Tier 1. So in that case when can they apply for ILR?
Thank you

If you apply for ILR based on long residence, they have to switch to FLR(M) which will be a new 5 year residence period towards ILR. Immigration health surcharge of £500 EACH will also have to be paid in addition to the visa fee.

Your wife could apply for ILR based on 10 years residence then when she gets to that point. Children will have to apply for ILR on their own at some point then.

Why not apply for ILR based on Tier 1 G, they can then apply with you if they have been your dependents the whole time.
