FLR(m) and the Health Surcharge

Good afternoon All,

6 months ago my Zimbabwean fiancé was granted a marriage visa (She was pregnant at the time and was living in Germany). We then got married and she gave birth during the duration of her visa.
Now we are applying for the FLR (m) and wanted to ask since we already paid the health surcharge 6 months ago, do we have to pay it again for our current visa application?

Is she not exempt because I am a british citizen and our baby was born in the UK? Do we have to pay the charge again?

Immigration health surcharge is NOT payable for a fiance visa. What exactly does the visa say and how long is it valid for and when does it expire?

We paid £500 health surcharge for the fiancé visa, it lasted 6 months and expired on 4 October 2016. This visa was the Join a family member

You definitely should not have paid the surcharge. Are you sure you did not get a refund??

She should have applied for FLR(M) before her fiance visa expired. Why has she not done this? She has no legal status in the UK now if her visa has expired.

For FLR(M), she will have to pay it again otherwise she won't be able to apply.

I will double check on whether we definitely paid the charge or not. I know that we paid close to £1000 for the fiancé visa application.

The reason we didn't apply until her visa expired is because we were trying to obtain all the evidence necessary for the new application. I was under the impression that we have a 28 day grace period from when her visa expires for us to make a new application. Are you saying that we will need to apply for another visa and not for the FLR (m)?

Are you saying that we will need to apply for another visa and not for the FLR (m)? What evidence? She would have only needed payslips and English requirement and adequate accommodation. She should have applied before her visa expired, that is the purpose of the fiance visa. As she has no visa, she should not be using the NHS either as she is not entitled now to free NHS.
