Tie-1 PBS Dependant (for my spouse as my ILR dependant)

Post by ram14esh » Tue Oct 25, 2016 6:35 am

Tier-1 PBS dependant form (latest version of 03/2016) does not ask for any English Language proof for Spouse.I am confused if my wife need to submit English language proof when she is applying for extension as Tier-1 PBS Dependant as I have got my ILR (recently in 2016) via Tier-1 General route of 5 years (my first UK entry was in 2010) and my spouse entry was in 2014 expiring soon. Pls advise. Also is there a FAQ sticky note & correct PBS dependant form link for PBS dependants under 'Immigration for family members'?Usually it will be there in this forum but i am not able to find it may be i am not searching properly or looking under a different index?Pls advise.

No, she does not.

Link below assuming the partner got ILR based on 5 years PBS route and not ILR based on long residence.

Thanks CR001 and yes I got my ILR via the 5yr route via Tier-1 General route and not via long residence route.
I have checked her passport and the current stamp says Tier-1 General Partner so assuming that PBS dependant route now is the current route. It is good to know english requirement is also not there but still she needs to prove the maint fund which is £630 for 90 days. But if sucessfully how many years will they grant extension as per the policy guidance docs it says 3yrs because only if 3yrs is granted she can avoid another extension and can got to ILR directly else need to pay for another extension.any idea if it will be 3yrs for PBS dependant who's partner currently has ILR?any such example in 2016?

An extension will be for 3 years. She can apply for ILR no sooner than 28 days before reaching 5 years residence, calculated from the date she ENTERED the UK.

Immigration health surcharge is also payable.

Thank you all got the BRP recently and yes they had given 3yr extension. I am trying to fill the same forms again for my kids but confused in Section L (Public Funds)

form link for ref: https://www.gov.uk/government/uploads/s ... _03-16.pdf

Section L - Public Funds
In this section you will be asked to provide information about whether or not you have claimed
public funds (benefits and housing) in the UK and details about any claims you have made.

For my spouse i said 'NO' against this question: L4; Have you claimed Child Benefit? and my spouse visa approved because she is not claiming any benefits.

How about in the children's application? It would be 'NO' as well as minor children's can't claim benefits?
