Need help with PR Application please

Post by STF2016 » Wed Oct 26, 2016 11:32 pm

I am EU citizen (A2) resident in UK since July 2007.
Obtained RC (blue card) in January 2008 and exercised Treaty rights being student from September 2007 for most of the 5 years first at college , then university. I have also been working short periods of time in between and since finished uni (2015).
I struggle to gather evidence for 2 periods of not working/studying while I have applied for Job Seekers Allowance. This was in the qualifying period (5 months first between July 2010 to December 2010 and other then 3 months from June 2011 to September 2011.)
I would like to ask you three questions and any ideas and information will be very much appreciated.

1- How will the Job Seeker allowance (the length of it) would impact on decision for my PR application?
2- is the Tax return enough to prove that i was on JSA? Do I need to prove I was on JSA?
3. I had no proper Comprehensive Health Insurance during years 2007 -2013 but found that my mom did EHCI for me and my sister (I was 18 years old when we moved) EHCI was issued by UK and expired in October 2013. Will I be asked to prove that I had insurance ? This was not compulsory when initially started to study...
Many thanks

1 - Being a jobseeker is fine and counts as exercising treaty rights, especially if the periods of jobseeking do not exceed 6 months.

2 - Not entirely sure on this one, but I believe you could use bank statements showing receipt of JSA or as you said your tax returns (if they clearly show for which periods you received JSA)

3 - If you had a residence card issued to you as a student before 2011 you can rely on the transitional arrangements and do not need CSI for periods during which you were a student. UK-issued EHICs cannot replace CSI, it would need to be an EHIC issued by another member state. But as you can rely on TAs this should not be an issue anyways.

Thank you for answering so fast.
Do I need to prove HO that I was actively seeking for job ? I think I must have proved this enough on fortnightly meetings at Job centre. I do have some emails kept I guess but does it make sense to send these too?

The requirement to show CSI is now enforced and applied retrospectively for student qualified persons unless you have an alternative or can avail of the transitional arrangement (as intimated above).
