Passport expired while waiting for appeal

Hi guys! I need help here. My visa was refused without right of appeal and thanks to my lawyer I got a hearing against home office decision. Now I'm about to complete my 10 years and my lawyer said I should do life in the UK exam as my status are still legal according to immigration rules.I don't have any forms of ID to do it so. My passport is being held by UKBA . I'm confused thinking what to . I heard renewing a new passport is illegal without a permission from home office. Please advice. Thanks a lot

Unclear why tagging onto ancient topic in completely inappropriate forum. Subject doesn't make much sense either.
You are not dealing with UKBA, they were abolished in 2013.
