Advice Needed- Canadian national with UK national mother

Post by Izzy888 » Sun Oct 30, 2016 2:33 pm

Hello,

I am currently living in London and am completing my masters program. I am hoping to apply for British citizenship based on the fact that my mother is a UK national, and my maternal grandparents are also UK nationals. I have copies of all of their passports.
Could someone please advise me on the best route to achieve this given the above information? Is there a special route I can take? Please note that I have been living in the UK on a student visa for 4.5 years.

Many thanks,
Isabelle

You may already be a British citizen on account of your mother being BC, i.e. no need to apply.

Where and when was your mother born and where and when were you born?
If your mother was born in the UK AND you were born after 1st January 1983, it is likely that you are a British citizen by descent and can apply directly for a British passport.
The more details you give us, the better we can guide you.

Hello,

Thank you for your response.
My mother was born in Canada, and so was I.
I am also born after 1983.

Does that provide you with sufficient information?
Thanks again,
Isabelle

Also, my mother received her citizenship as both her parents are UK nationals and born in the UK.

Your mother was herself a British citizen by descent and hence she is unable to pass on her citizenship to you automatically.

Both options (Sections 3.2 & 3.5) to register you as a British citizen likely do not apply to you as you are likely not a minor.

Your best bet at the moment appears to be going for an Ancestry visa, which is a five year work visa. At the end of five years, you can apply for ILR, followed in a further year, by British citizenship through naturalisation.
