Post by has1989 » Mon Oct 31, 2016 10:09 am

Hi,

i am filling eea (qp)form for my brother who is 16 years old. He is not working but he qualify as a student. In section 7 it asks you about your finances (7.9).He lives with me and i am claiming tax credit and child benefits for him. please help me to fill t his section. In section 7.9 it also asks you about the comprehensive sickness insurance cover. Please help me with that as well.

Last one as i told you guys that i am claiming benefits for him. So section 9 does that imply for him as well. if yes please guide me how to fill that section.

Help really appreciated.

Is brother an EEA national?
Are you?
Are you sponsoring him in some way?

Brother qualifies as a student in his own right if he has CSI in place. And sufficient funds.

Yes he is an EEA national. I am an EEA national as well.

he is living with me and i am claiming child tax credit and child benefits as his guardian. So i am responsible for his living expense.

He is currently going to college and enrolled on a one year course for which he is not paying.

can you please explain CSI.

thanks with regards

If you are the sponsor (a qualified person exercising treaty rights or else with PR already) and brother can be shown to be reliant on you then his activity in UK is immaterial. However he would apply as an EEA (EFM) rather than as an EEA(QP).
If a parent was sponsor then brother would apply as EEA(FM); no need to demonstrate dependency on a parent if dependent is under 21.

If brother is applying in his own right as a student qualified person (that is, qualified in EU context not in an educational context) then he needs health insurance (CSI) and adequate funds to finance his studies.
Apply for EEA(QP).

With all this wild talk of Brexit, it may be prudent to apply for your own EEA(QP) RC too (unless you are settled already).
