Tier 2 General extension during maternity

Post by Jhawar1982 » Mon Oct 31, 2016 10:30 pm

Hi All,

I have a question regarding tier 2 general extension and hope you can help me understand the rules.

My wife is on tier 2 general visa which expires in May 2017.
She will be on maternity leave from Mid December to First week of June and will be staying in UK during this period. Can she extend the visa in February 2017 while still on Maternity leave during which salary would be less than what is mentioned in the previous COS? Or is it advisable to extend the visa in December before start of maternity. Is there any rule that it cannot be extended 90 days before the visa expires? Would be grateful if you can suggest the best way to get the visa extension done.

Thanks.

although she can extend whenever she wants, and there is no rule stopping her from applying or extension in december, she can still apply closer to her visa expiry. The employer can issue a cos and say what salary is she going to be on, and having less salary during maternity is not a problem. They will only look at the salary just before she went on maternity.
