Regarding Tier 2, early extension, curtailment letter

Post by kumar114 » Wed Nov 09, 2016 12:46 pm

Hi all,

I got my first Tier 2 VISA in June 2013
But soon left the company during December 2013.

Then I just moved to another company as an intern(unpaid) and worked there without sponsor.
I worked as an intern until I got a 'Curtailment of leave' letter in March 2014.
Basically i worked wihtout getting sponsor for like 3 months.

After seeing that curtailment letter, my company did RLMT, assinged me a new COS and I applied and got the VISA in July 2014.
When I applied, my COS said Changes of employment.

My Current VISA ends in July 2017.
Also, let me add that the job that i did at my first company is same as the current one.
Same CODE: 2137

So my questions are:
1) Looking at my scenario above, how many years will i get during my extension?
2) Is it okay if i extend my VISA in February 2017? (Current VISA ends July 2017)
3) If I can extend in February 2017, what should be the startdate in COS?
4) I am not earning experienced rate right now. So is it okay if the COS says experienced rate in it but will actually get paid experienced rate when I get the VISA? Or my salary has to be at experienced rate before I apply for my extention?

Please let me know if its confusing. feel free to ask.

Waiting for the reply...

Kind regards
kumar

I am fairly certain that you are not permitted to do this on a Tier 2 G. You are only permitted to work for your sponsoring employer.

Hi CR001,
yes you are coorect.
But at that time, i thought i can still work as long as i have a valid VISA. So i continued working without getting sponsored.
But everything went well and I already have a TIER 2 General VISA now.

So could you please help on my queries?

kind regards
Kumar

So you were working in breach of your visa conditions.

Wait for others to offer advice on the technicalities of what you are asking.

They easily granted me a VISA after that also.. It is a points based system, if you get the points, you get the visa. Different rules etc for ILR and BC.

And I haven't asked any fraud questions. I don't know why you refused to asnwer my question. Where exactly did I say 'fraud'? I can't answer because I don't know or am not sure!!

1.You can extend you visa till june 2019.
2. yes, u can do that.
3. whatever.. it cant be more than 3 months in the future when the cos is being assigned. So if it is beign assigned on say 15 feb, it can be anything between 16 feb to 14 may.
4. you dont have to earn experinced rate before. as long as u earn that much as soon as the start date on cos starts/new visa start date, u should be fine.
