Hi guys and girls
I have been granted ILR on completing 6 years Discretionary Leave under Article 8 FM this year and will be applying for naturalization in 2017.
My spouse if non settled and non EU.
My three children are British (two aged 11 and 10 got via form T and on aged 3 via me being settled)
I came to the UK in 2000 as a student and later on my son was born in Belfast and acquired Irish Citizenship.
i switched to eea visa in 2005.In 2006 was refused extension of EEa visa and in 2009 was granted the same visa again. in the HO record I was over stayer between 2006 and 2009 although a solicitor told me that being the parent of an EEA child we can remain in the UK without a stamp or visa in our passport?
If that is the case can I apply for Naturalization next year or will have to wait untill 2009 when the visa was granted (or 2008 when i applied with a fresh application after the refusal in 2007).

There is no "EEA visa". What exactly did you apply for? Which nationalities do you have at the moment?

We apllied on form EEA2 ,non eea parents of an eea child (Chen case) and were granted limited leave to remain...self sufficient with no recourse to public funds and no excess to UK labour market. ..No employement ...No business allowed. In 2006 when the extension of this visa was refused. ..Was on the basis of us not being self sufficient, because the HO didn't get the additiinal financial documents on time. Appeal was disallowed in September 2007. When we were granted the same visa in 2009 after a fresh application in June 2008 ,the conditions attached were same. But in 2013 when my wife applied on the same basis she got permission to work. I though applied for ilr on 10 year long residence but was refused and was granted DL for 3 yrs under article 8FM which was extended in 2014 and now I m on ILR . Both the parents are pakistanis
