Questions about Tier 1 Entrepreneur Visa

Post by nyexpat » Fri Nov 18, 2016 4:36 pm

Hey folks,
I have several questions about the Tier 1 Entrepreneur visa with 200k;
i.e. studies
Is studying full time in a 4 year college an option; or is that off the table at the moment for this visa category.
Source of funds
Genuine entrepreneur clause.
-I will be receiving a gift from my parents; including the >200k investment amount+maintenance. Do they ask for proof of a significant net worth/funds outside being able to support myself without working or going on public funds? If so; how many x the investment would that be.

The rules allow you to study on Tier 1E visa but a person that dedicates most of the his/her time to studies rather than running his/her own business is clearly NOT a genuine entrepreneur and that is against the rules. There is Tier 4 for full time studies

Yes, you need to prove you can sustain yourself. It is required to show maintenance funds for yourself and your dependants on top of the 200K investment funds. It seems you never read the guide: https://www.gov.uk/government/uploads/s ... 4_2016.pdf

The genuine entrepreneur section doesn't seem to mention it.
you genuinely intend and are able to establish, take over or become a director of one or more
businesses in the UK within the next 6 months;
 you genuinely intend to invest the money referred to in Table 4 of Appendix A in the business
or businesses referred to above;
 the money is genuinely available to you and will remain available to you until such time as it is
spent for the purposes of his business or businesses;
Tier 1(Entrepreneur) Policy Guidance version 04/2016 - Page 19
 if you are relying on one or more previous investments to score points, that you have
genuinely invested all or part of the investment funds required in Table 4 of Appendix A into
one or more genuine businesses in the UK; and
 you do not intend to take employment in the United Kingdom other than working in your
business.
What should be the accurate interpretation of this section? Is there something I'm missing out on before I proceed?

Perhaps I didn't mention my situation carefully; how much in excess of the 200k is necessary? 50k per year? 100k?

Genuine entrepreneur test is a subject test that will determine if you are applying to run a business in the UK or not. It is up to you to prove you are in fact intending to run a business rather than using it as a way to come to the UK and simply gain settlement.

Maintenance funds ... Read the official guide. It is all there.
