I have taken a same day service for my ILR application for 1st week of December.
However, I have some queries. I am self-employed. My personal tax returns weren't filed for 2011-12 and 2012-13(I didn't get a notice from HMRC as well to file my tax returns for these 2 years). I had filed the personal tax returns for 2013-14 and 2014-15.
My Corporation tax from 2011 until date is absolutely fine.
When my accountant did a 5 year review he found that since the personal tax returns for 2011-2012, 2012-13 weren't filed, we sent the personal tax return by post in the month of September 2016 for the year 2011-12 and 2012-13. For 2012-13 I owed a tax of about 1200 GBP and I paid that amount to HMRC before the tax return was sent to HMRC by post. Since I owed money to HMRC, it went to tax compliance and they asked me to pay about 100 GBP for it which I did.
However, for 2011-12, there was no tax(0.00 GBP tax) to be paid. I got a letter from HMRC saying that 'Thank You for your Self Assessment tax return for the tax year 2011 to 2012. The time limit for making a Self Assessment or claiming a repayment for 2011 to 2012 ran out on 5th April 2016. Because of this, I don't intend to take any further action with the information in the tax return.'
My questions are :
1>Would I get a SA302 from HMRC for 2011-12 and 2012-13?
2>If I won't get SA302,since there was late filing,can I take Tax Overview Statement for 2011-12 and 2012-13 when I go for my same day service for ILR. Would the case worker consider the Tax Overview Statement for 2011-12 and 2012-13 if I don't have SA302 with me for 2011-12 and 2012-13 or is SA302 an absolute must for an ILR application. In that case, what are my options?
3>When would the HMRC records be updated so that HO can take a look at my 2011-12 and 2012-13 tax record as well to show that there is no liability to HMRC from my side for these 2 years.
4>Would you see impact of any of the above on my ILR application.
