Withdrawing an Application and Overstaying

Withdrawing an Application and Overstaying

Hi Everyone,

I have spoken with my lawyer and countless UKVI call center representatives but haven't had much luck with getting details on withdrawing my application and being considered an overstayer.

Would be appreciated if anyone can shed some light on this matter. I currently have a valid application that is still being processed after 3 months and 14 days from application (Aug 9). I have completed the biometrics (Sept 1) and the interview (Oct 14). The application was made before the my initial tier 1 entrepreneur visa expired but is currently expired (Aug 10).

I understand that if I withdraw my application my passport will be sent to the airport of my choice and I will have to go through the voluntary departure process but does that mean I am an overstayer and will the one year ban be in effect?

Yes, you will be considered an overstayer as your visa has already expired and your section 3C cover ends when you withdrawn your application.
