children born in UK

Post by sousim » Mon Nov 28, 2016 11:11 pm

Dear All,

I need your advise on my following case;

I am due to apply to ILR on December 2016 for me and 5 dependants (spouse, 4 children). Two of my children born in UK in 2001 and 2003 when I was a student then left UK on July 2005 after completing my postgraduate studies. I back to the UK on 2012 under Tier 2 general (Employer sponsored). Since then the two children are living with me in the UK and holding leave to remain visa and BRP like the rest of family members.

my understanding from all posts in this regard at your forums that I can exclude the two children who born in the UK from my ILR application and only include my spouse and the other 2 children who born outside UK. once I get ILR for me and my spouse then I can register both children born in UK as a British citizen using form MN1.

is above correct and straight forward case, or you have feedback to help me before I finalise my ILR application.

The UK born children are entitled to register after a parent is granted ILR. But there may be complications, if they are overstayers and aged over ten.

Thank you. links provided to overstaying and complications has helped much to understand.
the two children always stayed legally based on granted visa and both still carrying leave to remain until end of November 2017.
I understood that good character is a key issue for children to register as British citizen, is there any other areas they look at under complications?
