Tier 1 50k extension-- Road Accident

Post by xeesee » Tue Nov 29, 2016 8:49 pm

Hello everyone,

I will apply my FLR next month and i need some help.

Question: I had a minor road accident in 2014. i did not accept that its my mistake but court gave the decision in support of the other driver in jan-2016. My insurance company paid all the expenses and personal injury claim amount to the other driver. Does that effect my extension case? Do i need to declare this anywhere is the application?

please reply

Thanks

If you received a conviction in the court, yes.

can you please explain this. what do you mean by conviction on me. court gave the order to my insurance company to pay other driver the compensation amount. is this conviction? sorry i am not clear on this.

conviction is a formal declaration by the verdict of a jury or the decision of a judge in a court of law that someone is guilty of a criminal offence.

There are no points or code on my Driving licence and not received any other letter from court.

i were insured at the time of accident its only a dispute of error.

Thanks zimba

This is a question to ask from solicitors and not on an immigration forum. If you are convicted, you need to declare it otherwise no.

Hello there

This is your private matter, there is nothing to do with HO.
So do not worry, you are ok with it. And you not need to mention to HO as well. This is no conviction against you. You are not guilty of any criminal activity.

Hope it helps.

Regards

You should't worried If it's a routine judgment.
Any conviction or penalties issued by court even in civil matter can effect an ILR application.
If it is something which includes criminal or gross negligence , driving without proper insurance or driving licence, drunk or dangerous driving etc will lead toward a negative effect rather then simple conflict resolving judgment against someone in a routine insurance matter.

The criminality threshold is there to judge the "character" of an applicant not his routine life issues.
