Tier 2 General returning to the UK after termination

Post by idol777 » Tue Nov 29, 2016 11:38 pm

Hi there,

I'm a Tier 2 General migrant and am being made redundant on the 2nd of December (Friday) while my current leave is valid until 2019. I'm now outside of the UK and would like to get back on the 4th (Sunday). How big are the chances I'm going to be stopped at the border given it's just 2 days of unemployment and I won't have received my curtailment letter yet.

Thank you.

It will depend if your employer has already informed UKVI about the redundancy or not. If they have, and it is appearing on their system, you will be stopped at airport and refused entry.
For anyone who is out of country, a curtailment letter is not issued.

One point to consider

If you return to the UK and state you no longer employed and have been terminated you will be returned home. If you fail to declare the true circumstances then you will be employing deception to enter the country. If this comes to light at any any point in the future then it will be a mandatory 10 year ban with all the issues that causes for entry to other countries.

So even without a curtailment letter, even without your employer informing UKVI you are still employing deception by entering the UK and knowingly not declaring the truth.

My advice is to stay in your home country and serve your one year cooling off period and accept your circumstances.
