EEA PR Application

Post by Sermar » Tue Dec 13, 2016 4:51 pm

I am an Italian EEA national married to a British Citizen Woman. I've lived in the UK for 22 years and now and am apply for EEA PR .
I am very worried about this Brexit , I am 58years old and I have worked in the UK only for a couple years 22 years ago, because i became
disable and from over 20 years i m registered disables and getting disability care and mobility also
my British wife is my registered carer, and we also get carer's allowance for this reason.
Will I be considered to have been exercising my treaty rights even though I am a disabled person over 20 years and living there?
also i get all 20 years tax bill as disable person with all benefit housing and tax reduced .
Please can anyone help me before i send the application EEA PR pls? I will appreciate any response from you.
Thank you for taking the time to read this.

Welcome.

EEA Regulation 5(3) for a 'Worker or self-employed person who has ceased activity' may cover your case.

That is if applicant terminated his activity in the United Kingdom as a worker or self-employed person as a result of a permanent incapacity to work.
Had you lived in UK for at least 2 years before such a termination?

See http://www.eearegulations.co.uk/Latest/ByPage/part1_5

It would also be worth checking your original passport to see if you had got ILR on (or soon after) your initial entry to UK back in the day.

Have you checked for any ILR stamp in any other old passports?
If you have one then you won't need PR status.

Otherwise its form EEA(PR).
I'm not too familiar with this area (Regulation 5) so suggest seek other advice too.
Good luck.

Did you stop work before the disability or the disability was the reason you ceased work?
