English Language Assessment -- Tier 2 to ILR

Post by Skobs » Wed Dec 28, 2016 2:52 pm

Dear Members and Administrators,

I have gone through the FAQs on the website as well as through the forum but could not find anything specific to this, hence decided to start a new thread. Please redirect me to an existing topic if it exists.

I am on Tier 2 (General) category visa - first came to the UK in October 2011, got the visa extended in September 2014 and am now eligible to apply for an ILR.

I used the same degree (B.Tech, earned in India) for both applications and they were accepted (under the PBS rule). Now, of course, they have turned off the calculator and the guidance on Gov.UK suggests that NARIC certificate is needed for degrees taught in English but outside the UK.

However, going through the guidelines in detail, it seems like if the degree has been used previously, no NARIC certification is needed.

I am a bit confused, so was wondering if any of the members have used a degree used previously (without NARIC) or if the administrators have heard/seen such cases.

Thanks a lot in advance for the help.

PS:

1. This is the relevant text from the detailed guidelines (page 34 in the pdf) - am I reading it incorrectly?
If we have previously accepted a degree qualification as meeting the requirements for an earlier application, and leave was granted, we will not need additional confirmation from NARIC.
2. I did call the UK V&I helpline and they confirmed it but they have been known to say conflicting things (from what I gather after reading through the forums).

Hi all

I have the same question. For Tier-2 I passed the language requirement in the PBS system on the basis of my academic degree. Now I am going to apply for ILR. According to the guidance, as the previous post suggests, I shouldn't need a NARIC certification.

Can someone confirm this is the case?

Thanks
ACWT
