Most employers are ignorant of EEA laws. Did you get right of appeal? You have 3 months and a day from your dismissal date to make a claim of unfair or wrongful dismissal with ET assuming your have worked for 2 yrs with ur employer. Buy yourself time and go through ACAS as this is a compulsory step to make a claim. If you are not working, you can claim a fee waiver if it is not resolved through ACAS.
First look at what your employers right to work policy states. They should not dismiss you if you have provided evidence of in time application with HO. They have a duty to verify your documents with home office if they are in doubt6. It is plain wrong and checking service is not a hassle at all. Claiming unfair dismissal is not dreamland as it is expensive for the employers. Some cases dont get as far as tribunal as the issue gets settled bf then. Buy yourself time so that by the time you get COA, ACAS will be able to help you negotiate a reinstatement. If you do nothing now, you might not get reinstated and you cant fight them as you have been dismissed

Its not a question of ignorance. Its too much effort involved. Employers do not care. You have mistaken the meaning of verify. That requires submission of a document COA that states you have a right to work. The rules as shown earlier say "the employer MAY accept . Its all good to be talkign about right and wrong but the facts on the ground are different. ACAS is not as helpful as you make them out to be. They will type out a request for reinstatement. It is not mandatory for the employer to re apppoint.

It is really ignorance because employers get statutory excuse if they use the checkin service. Employers not caring does not make it right and thats why Tribunal is there for protection.
ACAS is not as useless as you make it out to be. Their service in this regard is only conciliatory. They will issue a reference no that will enable employee lodge a claim with tribunal if an agreement is not reached any way.
Tribunal is costly and damaging reputation wise for employers so they will rather settle complaints outside tribunal.
Vpalma is better of going through ACAS to have a better chance of reinstatement as he has been dismissed. He can actually also claim facial discrimination apart from unfair dismissal. He has nothing to lose. Tribunal can make an employer reinstate an employee. He will lose out if he does nothing. By the time it gets to tribunal, vpalma must have gotten his PR anyway and employer will reinstate or face tribunal. Just complete the ACAS early conciliation form.

I do agree theoretically you are right. But my suggestion is not to antagonise the employer. Also it depends on the employer. Some dont care for the Tribunal.
A big company may be concerned about its reputation while a smaller one may not.
The way I see it is its not unfair dismissal. The requirement is that the COA should state right to work. That has not been produced. The rules do not state MUST but MAY. So its discretionary. There is no case for (r)(r)acial discrimination at all. In that case all EU applicants who are terminated for non submission of docs. will claim that. ACAS is concilatory. It would mediate. But now there are costs involved. Earlier it was free. But yes calling them and asking for advice is free so he may give it a shot. But keeping an eye on the Tribunal which it may not come to, seems to be pushing ones luck. This may destroy any good will the company has towards Vpalma and refuse to reinstate. ACAS may request the company to reinstate but cannot compel.

Congratulations deeW!

Your timeline gives me hope that the 240 extra staff the HO started to hire in March (http://tinyurl.com/ycj7out6) are now working and that they are managing to get rid of the backlog!

I applied one day before you, my documents also arrived in Liverpool on the 13rd Apr and my Biometric letter was issued on the 12th Jun (done 16th) but unfortunately still haven't received my documents and PR back. Hopefully they are now looking into requests received mid-April and that my case is also resolved soon!

May I ask you what was your qualifying period and if the status of your application here http://tinyurl.com/y7d3m7ud still appears as Awaiting a decision or have they changed it to Decided?

Thank you!

Just wanted to share my timeline and thank all of you who shared theirs.
Applied as EU national A2 - worker, with Tier 2 visa issued 2005, however never registered after we joined EU
Applied online: 01.05.2017
Payment taken: 01.05.2017
Sent papers: 02.05.2017
Received by HO: 03.05.2017
Awaiting decision updated on: 03.07.2017
DECIDED: 26.07.2017
Received PR and documents: 07.08.2017
PR issue date: 27.07.2017
Permanent resident status deemed: 27.04.2017 based on the documents provided, however I sent P60 and some payslips for 6 years back from February 2011 and explained in a cover letter the reason I am sending 6 years is so I can be deemed PR from an earlier date so I can apply for citizenship... Not sure if this is a printing mistake, considering they should have a record for at least 6 years. Has anyone had anything similar?
Good luck everyone!

Congratulations on receipt of your PR. Was in a similar situation. I sent the caseworker an email pointing this out and the date was reviewed and new letter sent after a few days. Try this and see.

Add a dot between your case workers (whoever signed your letter) first name and surname @homeoffice.gsi.gov.uk

Ok lets not deviate from topic.
No one sent me an email. Figured out the email myself. Organisations use first name and surname for their employees emails. Luckily my caseworker responded after 2 days. It will depend on your case worker. Yes add your case ID.

Please start a new thread if you are going to ask further questions as this forum is for permanent residence timeline only. Cheers.
