T-4 (Dependent) to T-2 RLMT

Post by Amar0201 » Wed Jan 11, 2017 12:58 am

Hi all,

I need some regarding the RLMT when switching from T-4 (Dependent) to T-2 (General).

I got my master's degree in Sep 2015 and in Feb 2016 I switched from T-4 (General) to T-4 (Dependent) because my wife was doing her master's degree at that time. Now I've got a job offer from a company that is willing to sponsor me. However, my visa experies in 2 weeks (on the 26th), which effectively means that the company is not be able to finish RLMT and issue a CoS in time, because if they start the process tomorrow, the earliest date the CoS might be issued is 13 March.

My question: is there a way to get a CoS without carrying out the RLMT (I know that most probably there isn't, but I just wonder whether I can ask for an exemption on the grounds that I used to be on T-4 General for 5 years until Feb-16)?

Alternatively, could there be any tricks on how to get the CoS and apply for T-2 without having to leave the country? E.g. applying for T-2 on 25th of January without CoS to avoid being an overstayer and then sending the CoS along with a cover letter, explaining the delay?

Thank you very much for your help!

No tricks or shortcuts present. U have to apply with a cos before your visa apply with rlmt to be completed.
the only way rlmt is exempt, if your job is under shortage occupation .
Besides this, you do not just need a normal cos. u need a restricted cos, and applying for that is not as straight forward as the un-restricted cos is.
If i were u, i would go back home, ask company to complete the rlmt, apply for restricted cos and then apply from home country,.

A little unclear why you seem to assume RLMT outcome will be in your favour.
Suggest have a Plan B just in case.
