apply for spouse visa after marriage visitor visa refusal?

Post by JEFF1985 » Tue Feb 07, 2017 5:39 pm

Hello ,this is Jeff. I wanna know if I could apply for a spouse visa after my marriage visit visa refusal ?

below is the reasons from the UK VISA IMMIGRATION

* your application, and any additional relevant information you have provided with it
your immigration history

The decision

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s)V4.2,of Appendix V:Immigration Rules for Visitors because:

You have applied for leave to enter to visit the UK for two months and 28days for the purpose of your marriage.

*I have considered the information you have provided about your personal and economic circumstances. You state that you are employed as a saleswoman with ****factory earning 4000RMB(£400)per month after tax.You further state that your fiancé is funding your visit and will provide you with RMB10000(£1000) for this purpose. You have provided bank statements,a letter from your employer and payslips in your husband;s name as evidence of your claimed circumstances.

*You previously visited the UK on 15 May 2015 and returned on 26 October 2015,a period of five month and 11 days.It is noted that initially stated on your visa application form that you intended to visit for 10days.You stated that you would visit friends and visit for tourism and shopping. The letter of explanation you have provided with your application states that you went to the UK to visit your boyfriend. In addition, you state that you quit your job whilst you were in the UK and studied English for one month during your stay. You did not disclose the fact that you had a boyfriend in the UK in your initial application.I n resigning from your job whilst you were in the UK I am satisfied your circumstances sufficiently changed in such a way that would have been to detriment of your visa application had you been unemployed when you applied. It is unclear why you were not required to work a notice period for your previous position in China. You state that you decide to quit your job because you wished to see if you and your boyfriend were suitable for each other. However, you have not demonstrated in your application why you have to resign from your position in order to stay in the UK on this particular visit.

*It is noted that there are regular salary payments into your account. However, shortly before your date of application, on 5 and 6 july,2016, there were large deposit into your account totalling £3000.You stated that there were loan repayments from someone. However, I am not satisfied you have demonstrated the source of these deposit in your application and that your financial circumstances in china are as claimed.

You intend to visit the UK to get marred to your finance. It is noted your fiancé works and resides in the UK and you are employed in China. You previously visited the uK and resigned from your job whilst there, eventually staying for over 5months you initially stated you would. You have not demonstrated in your application what your future plans are with your fiancé or where you plan to reside following your marriage.
*It is our responsibility to demonstrate that your personal circumstances in China are such that granted leave to enter, you will comply with all of the conditions attached to any such leave that you will leave the UK on completion of the proposed visit. The documents you have submitted do not demonstrate personal or economic ties to China and I am not satisfied that you genuinely intend to visit on this occasion.I am not satisfied that you are a genuine visitor and will leave the UK at the end of your visit,Your application for a visit visa has been refused under paragraph V4.2(a)and(c).

Are you married now>?

What was your aim of the marriage visit visa? This would not have allowed you to remain in the UK after marrying.

Not telling the truth on application forms to UKVI is never a good idea.
