Moving from Germany to the UK

Post by Lunaka » Wed Feb 15, 2017 10:15 am

Hi everyone,

I found this website online and was hoping someone can answer my questions, as I could not find any answer without getting confused and scared.

So I am a Dutch Citizen living with my non-eu husband in 'Germany. My husband has a ID for family member of an EU citizen. So I got offered a good job in the UK, but I dont know if this would be a good move for me with the BRexit problems at the moment.

Can I move to the UK easily and what do I need to do exactly to keep my husbands rights.
The main problem I currently have is how do I enter the UK if we unregister ourself in Germany and his ID card will be taken from him, as he will not have any valid ID card to enter the UK after. and will Brexit have any effect on my right and my husbands living in the UK in the future.

( I understand this is hard to say, but I get very confused about all the articles) On some places I read that EU citizens will be safe than I read other stories that it is not sure.

Did anyone move from Germany to the UK? and how did you do this. Would it be smart to go to the UK with a Dutch passport and a non eu husband. Or would it be smarter to stay in GErmany/Holland.

Thank you so much in advance for your answers

Your husband should apply for an EEA Family Permit (processing should take no longer than 15 days) and once in the UK and you have your first payslip and salary showing on your bank statement, he can apply for a Residence Card, just like he had in Germany.

If you and your husband will be able to stay beyond Brexit and what kind of requirements have to be met then - if any - is unknown so far and I imagine it will take quite some time yet for that information to come through.

In any case, you can always move back to Germany or elsewhere, if UK life doesn't turn out great.

I for one will be leaving next year. While I do not take Brexit personally, I still found myself detaching my future and long term plans from the UK in the months since the referendum. I have decided not to buy a property after all and will go back to Germany to be closer to family.

As I know according to law if your non EU partner got article 10 card stating family member of union citizen . Non EU partner can travel straight away with EU partner without family permit.

Wait for other answers like noajthen casa obie.

Thank you both for your reply, this information really helps.

And my husband has a card as a family member of Eu citizen so he should be able to travel without a visa for the UK. We havent tried it yet, but based other sources it should not be a problem.

Hi, yes the non-EEA family member can travel to the UK with an Article 10 or Article 20 Residence Card from an EU member state.

However, be aware that UK immigration strongly recommend you get an EEA Family Permit first to avoid any issues at the border. If you can't prove entry requirements for the non-EEA family member at the border then they might not let them in.

Always better to be safe than sorry, and the Family Permit is free.

thank you for your reply.

This might be a good idea indeed. Do you also maybe know where I can get the family permit for free. I tried to fill in a form on https://www.visa4uk.fco.gov.uk/home/welcome and even made an appointment in Dusseldorf. And then I was not sure if this was for British people with a non eu spouse so I canceled the appointment and hoped to just get in with my husbands residence card from an EU member state.

So was this the correct website or is there somewhere else, or can I go without an appointment. IT is kind of confusing all these different websites.

Hi again, yes that is the correct website. It is for EEA Citizens with non-EEA spouses. You do need an appointment and you have to submit the form online.

Of course, you can try to just get in with your husband's residence card.

Don't forget to unregister in Germany! You will need the deregistration certificate to cancel your German health insurance or they will invoice you at maximum until you unregister.
