Change of Employment Salary Requirement (Urgent)

Post by ozayh.malik » Thu Feb 23, 2017 12:37 pm

Hi @hassanh

Thanks for your reply.

I would be able to apply after 6th of April.

It means if my employer shows 37.5 hours a week then 28862 should be fine?

you will have to be at least on 30000 after 6th April regardless of reducing number of hours. Best is to apply before April with more than 25K salary.

Thanks,

I cannot apply before 6th of April because my employer is conducting RLMT. It has to be after 6th of April. So, they have changed the minimum hours' requirements from the policy. The full-time job salary has to be 30,000 doesn't matter how many hours you work 39 or 37?

Please, be advised that if during RLMT they find another suitable settled candidate, then they will need to offer the job to that person.

It seems like you are pre selected for the job which can lead to refusal of visa.

Thanks,
Hassan

Yes, they have already interviewed me and now they are conducting the RLMT. In the test, they will conduct interviews as well but not mine. Its a different employer. Would it still be an issue?

Another thing is that I just notice that in the RLMT they mentioned 28000 maximum pay. So, If they pay me 30000 would that be an issue as well or not?

If they find another suitable settled candidate during this interview, then they should offer the job to that candidate. Also, I believe they should be interviewing you again with other candidates on order to have a fair RLMT.

Pre-selection is not permitted in Tier 2. What is the point of getting other candidates in for interview if they have already decided to give this job to you.

Yes it will be a problem, as the employer cannot offer more than what was mentioned in RLMT.

Thanks

@hassanh

Thanks for your reply. Well, they have not offered me the job yet because they are conducting the RLMT as I am aware of that they can find a suitable candidate in this process. They are not going to interview me again during the test because they already did.

If they offer me the job then the salary limit in the RLMT would have been an issue. If they assign COS with 28,000 before 6th of April and I apply for the visa after 6th of April then that would be an issue as well for salary. am I right?

I am not sure on this, wait for seniors to respond. Actually, no clear instructions have been issued by UKVI on this. All I know that they said from April 2017, the minimum salary to Tier 2 visa will be 30,000 at least.

Thanks,
Hassan

Pro Rata salary Explanation needed

Post by ozayh.malik » Fri Feb 24, 2017 9:56 am

Hi All,

Could anybody please explain this paragraph? According to this paragraph if my employer pay me
769.24 pro rata (28,462 / 37) So there will be no issue with my visa extension.
If the appropriate rate is £30,000 for a 39-hour week (£769.23 pro-rata) and the
applicant will be paid £29,000 for a 37-hour week (£29,000/37 = £783.78 pro-rata),
the salary should be pro-rated as this would mean an application which would
otherwise, fall for refusal may be granted.
Thanks
