Quick question regarding Non-EEA Spousal visa

Post by MrScarface » Tue Feb 28, 2017 4:13 pm

After looking up the options me (EEA NAtional) and my wife(non-eea national) have in regards to moving to Ireland, I have a quick question as I have been unable to find a concrete answer to this:

When we move to Ireland, is my spouse allowed to start to work immediately?
Earlier on we have been looking into the UK process and for that we would need to apply for a Family Permit from outside the UK which allows my wife to enter the UK and start work immediately, after that we apply for a Residence card.
However with Ireland I have been unable to find any hints of a comparable system in place and it seems like while I could start to work in Ireland right away, my wife would only be allowed to apply for a residence card once in Ireland and needs to wait until that Residence Card is issued before she is allowed to pick up a job.
Is this correct? Or am I missing something?

@MrScarface I think this link should contain all the information you need.

Since you didn’t specify your nationality I will assume you are Swiss or EU/EEA citizen (except Irish), if you are Irish national the process to follow is slightly different.

http://www.inis.gov.ie/en/INIS/Pages/EU+Treaty+Rights

Acknowledgement of receipt of applications and the grant of temporary permission pending a decision on the application can take up to 12 weeks or more, your spouse should be able to work with that temporary permission but apparently is taking up to 12 weeks or more.

Thank you, I am German and so from what it looks like we enter the country, my wife applies for her Stamp 4 and a temporary stamp 4 and only once she gets that temporary stamp she is eligible to work?
In this case it is really unfortunate because my wife would be the one who very likely could get a job at the irish office of her current workplace, but without getting transferred. So she would be the one to potentially have a job from the moment we enter the country however that is worth little if she's not eligible to work right away.

Hi,
Do you have any update on this?
I have a similiar situation bringing my non-EU spouse to Ireland as a German citizen.

Any help is appreciated.

Cheers,

Leo

She will be able to work legally right away, only problem is that she wont be able to prove that until she gets her resident card, which is about 6 weeks, if everything goes well.

The eu treaty right gives her the right to legally work, but in a workplace they wont be familiar with this, many immigration worker wont know the rules so what can u expect from the employer....but if the employer believes you, than she is good to go
