FLR (M) renewal for US Citizen help

Hi,

 

I have been panicking and really need someone to help if they know the answer.

 

My wife is a US citizen and we got married in Sept 2014 (within 6 months of fiance visa) and then applied for marriage visa which is now up for renewal after 2.5 years (April 2017) (5 year route)

 

I meet the financial req as my work contract annual salary is above £18,600...HOWEVER...i have been ill over the last 6 months due to a medical issue, which i was born with, and as a result i have been receiving SSP plus the odd day of work where I have been able to go in.

 

I haven't been receiving my full pay, and my payslips reflect this (as well as my potential annual salary), but i am still employed by the company and my annual salary is still the same. I am back on the mend and have been cleared to return to work on FT basis again but I am very worried this will affect my wife's renewal due in 6 weeks.

 

Will my illness and not earning the money affect her renewal? Or is my work contract as well as letter from employer confirming details of the contract to be correct be enough to meet the requirements. I will also be submitting the payslips but they are well under requirement.

 

We have a 1 year old son (born in UK) and im so worried my family will be split apart.

 

please can someone advise me?

Does your wife work?

If not and you don't meet the financial requirements, she can apply on FLR(FP) 10 year partner route.

She did work up until last week as a nanny but her employer terminated her contract (mutual agreement ) and has been working since she arrived in 2014 paying her taxes etc.

With regards to if I meet financial req I do not know as this is my question from my first post...

My work contract and letter from my employer says I earn £18.6k + (And have earned that since 2013) but I have been sick In the last 6 months so have not recieved full pay on my payslip, just Statutory Sick Pay (SSP).

So do I meet the requirements?

You need to provide evidence that you meet the requirements in the form of 6 payslips and 6 corresponding bank statements showing your salary paid.

I am not sure if SSP is sufficient.
