Re: APPLYING FOR ILR BUT SPONSOR IS NOW WORKING PART TIME

Hello Admin,

Thank you so much for your reply. I am currently receiving NHS bursary and on part-time job (24 hours/week). When I apply for my husband for his ILR, is having a maintenance fund on our bank account enough? I am just worried that I am the "sponsor" and my dependant husband is earning more than me and he looks like the one sponsoring me..

Also, is bursary considered as public funds? I am receiving it on my name, so technically, my husband is not the one claiming. But the money goes into our joint account..

My worry came from a story of a friend, wherein the husband got denied because apparently the sponsor is out of work and the dependant is working for them. I know my circumstance is different but I just want to make sure to avoid any unnecessary stress when the time comes.

Please help us.. Thank you so much.

I have split to your post to its own topic to avoid confusion.

What visa exactly are you/hubby applying for?

Hello Admin,

I am also silvani. I sent you PM that I couldn't log in on that account when I tried to forget password. I am not receiving any new password to reset it.. I have ILR based on Tier 2 and my husband is PBS Dependant who needs 5 years to have his ILR. He came January 2013. We are planning to apply for his ILR this coming December.

From which category?

What is your category of visa and his category of visa?

Your post is not clear.

Hello,

Sorry for the confusion. I have ILR at the moment. I used to have Tier 2 (General Visa-PBS). My husband is currently on PBS Dependant leave and will apply for ILR this December. He is under the new rule where he needs to complete 5 years to get ILR. I sponsored him to come to this country (maintained £630 at the time) and I was working full-time. At the moment, I am now studying and only works part-time. Will this be a problem when he applies for his ILR because I used to be his sponsor and used to work full-time (earning less than £18,600) and now it looks like he is the one sponsoring me if you know what I mean.. Thanks a lot..

There is no income requirement for PBS Dependent applying for ILR.

Oh wow. Thank you for your swift response. I have been having sleepless nights because of this. Thank you so much! Just to clarify something, we still have to maintain £630 at least 3 months prior to his ILR application?
