Hi,
My name is Manasa and I am on Tier 1 dependent Visa from India and my husband got his citizenship last year. We are planning to invite my parents to visit UK. My father is an agriculturalist and mother is a home maker. They have travelled to US twice but this will be first time we apply visa for UK. We have plans for more trips for them in next 2 years and we got two options in our mind:
1. Apply for long stay visa for 2 years or
2. Keep applying short stay visa every for every six months

I tried searching more information on cases getting successful in both the scenarios but unluckily I didn't find much information. For long stay visa, we can give reason to the government by saying that they will be visiting us and show the proofs of their property for the reason to return. But please could you suggest how far it will be successful.

On the other side, we should apply short stay visa for them where as they come and stay here with us for 6 months. But what if we want them immediately after a month or two to travel again? Can we again apply for family visit visa and will there be any obligations for their approval.

Your valuable suggestions will really help me. Thanks in advance

Visit visas are for short visits, six months is a no-no and if they did that, they'd never get another.

Visa is six months validity, not term and not to be used for residency.

Thanks for your reply. But we are not interested in their residency. They would be visiting us 3 times in next two years. So we were thinking for applying 2 year long stay for them. So that they can go once for Visa stamping. Where as for short stay each and every time they need to travel to UK. Please give us your suggestion.

The point Wanderer is making is that they should not be visiting for 6 months at a time, this is not considered a visit but residence. They cannot be spending more time in the UK than they are in their home country. This is a tactic many people have used to by pass the immigration rules and UKVI are hot on this.

How long do they plan to visit for EACH visit in the next 2 years?

Hi,

Initially 5 months and then a gap of 3 months and again stay with us for 5 months and then depends if they need to travel to us or not. But if chance may after 6 months gap again we want them to be with us for another 5 months. The gaps they may spend in India or travel to USA.

Please suggest the best one.

Please also clarify me, if I apply for 2 year long term stay. If I plan to get my parents this April and they stay with me for 4 months and then go back to the home country/USA and again travel in the month of November and stay still March 2018 and then a gap of 6 months or more. As we didnt think the later time. B But if the plan is the same but instead of 2 year long term stay can we apply multiple times for short stay visitor visa?

4 months is too long and a 2 year visa is unlikely to be granted without a prior history of abiding by the terms of entry both in law and spirit.

If you consider this simple equation

No more that 180 days stay in the UK in any 365 day period.

So if the first stay is 120 days then that leaves a maximum of 60 days for the next 8 months.

Your proposed visiting periods would exceed that so you are heading for issues.

Thank you all for your valuable feedback. thanks @Frontier Mole, now I understand that my mom can stay for max of 6 months in a year with me. But please could you help me understanding this

First time my mom will stay from May 18 2017-Oct 18 2017 which is 5 months and then what if she travels in December and can she stay till April 2018. In this case in 2017 she stayed for 5.5 -6 months and in 2018 She stayed for 4 months.

So will it be considered as viable?

I appreciate and will be grateful if you could reply me.

No, you are misunderstanding it. She cannot stay in the UK for more than 180 days in ANY 12 month cycle, it is NOT based on calendar years. If she stays like you are proposing, she is residing and is not a visitor and will be spending more time in the UK than her home country, a clear indication that she is not a genuine visitor but using a visitor visa to live in the UK and to get around the immigration rules.

I am stuck while filling application form for Visitor Visa

Hi,

I am helping my mother in filling her application for applying visitor visa to UK. There is a question under Personal Details & travel history asking that

Have you been refused a visa for any country including the UK in the last 10 years?
My parent's visa application for USA was rejected when they applied for the first time and second time they got 10 years visa.

So should I answer Yes and give the reason or should I say NO.

Please help me with this.

The official guidance for UKVI Entry Clearance Officers states:
"There is no specified maximum period which an individual can spend in the UK in
any period such as ‘6 months in 12 months’. However, if it is clear from an
individual’s travel history that they are making the UK their home you should refuse
their application
."

However, note the following paragraphs:
"You should check the applicant’s travel history: how long are they spending in the
UK and how frequently are they returning? You must assess if they are, in effect,
making the UK their main home
."
AND
"the number of visits made over the past 12 months, including the length of stay
on each occasion, the time elapsed since the last visit, and if this amounts to
the individual spending more time in the UK than in their home country

• the purpose of return trips to the visitor’s home country and if this is used only
to seek re-entry to the UK
