Thanks for sharing the information. My Solicitor sent appeal on 26th Oct. he did not ask any information or documents from us to send with the appeal. As a confirmation we have just received the email which he sent to court not with the attachment of appeal bundle.I really do not know how this appeal system works. I assumed that solicitor will just request the hearing date with appeal grounds now and he will need us just before the hearing to prepare everything.
By the way, can you please elaborate how you prepared your appeal bundle.
Pls keep us posted whenever you get the dates from court.

Same here solicitor have jus sent appeal .fee deducted and got acknowledgement letter .solicitor said we jus need to sent appeal now no other documents ,need to take appeal bundle with us on hearing date till that time jus keep gathering letters from school which u think is beneficial for your case .

Hi Monz, you seem to be a step ahead of me. The solicitor should be sending our appeal today and we will then expect the hearing date next. As your appeal has already been sent, you will get it earlier than me, please keep us posted.

I just needed to pay the solicitor fee for this appeal and will pay the court fee £140 for each applicant. Once we get the date then they will start preparing our bundle.

Did your solicitor charged you a separate fee for the appeal itself?

In terms of school letters etc, I will have to open up to the headteacher about our case and hope she can be sensible and help.

Will keep you posted.

Yes our solicitor have charged her own fee of £350 .and appeal fee £140 is separate.not sure when we will get appeal hearing date as some ppl says it takes 6 to 8 months .but in few cases they got hearing date in a month .we can only pray may Allah makes everything easy for us.

Hi,

I have a problem with these fees paid to solicitors then they claim to use it to pay the court fees. Did you pay the court fees yourself or you it all to your solicitor?

I am aware that people can apply for a fee waiver and it doesn't look impossible to me that solicitors would ask us to pay transfer all the money to them and then do some work to not pay the fee(by claiming a fee waiver) and then keep the money for themselves. Am I too paranoid?

When we submitted our application a year ago, I transferred all the money to my solicitor and ask for a proof or a receipt, they attached a cheque to my file and showed me when I was there for the meeting. But a cheque can be binned easily right? It's not like a home office proper receipt.

I asked for a proper receipt but never got it.

What do you or anyone here think?

I am also submitted my dependents flrfp two weeks ago. I want to ask one question could anyone help me please.
In 2017 I applied Ilr and my dependents flrho because I was not sure get ILR that's why applied dependents flrho. I got Ilr and my dependents application was pending at ho I had informed them I got Ilr but still ho refused my dependents application not appeal rights given.
Three weeks ago within 14 I applied again my dependents flrfp as family life of settle person in uk.
My question is should I vary the application to flrM or not? Because now I have meet all flrM income requirement and my wife done English test.
Please help me. Thank you all

Hi,

If you have met all the requirement for FM and you have done your job for 6 months, I advise that you should vary the flrp fp application. I am currently fighting a case of refusal with ILR, non overstayer and two children who were born here. So, to avoid issues relating to this, you should vary your application. This is what I think but you can speak to a solicitor too to find out.

hello, all specially bathanza and other fellows
today at the morning 5:30 am knocked on the door but it didn't knock it was proper banging
my mother in law ask who is this they replied immigration.
she opened the door and they asked is ------- living here. she said he is here then she asked from my mother in law is he your husband (how silly it is).
she said to them he is my son a law.the said can you sign the paper then we will come in she said to them sorry we got a dog and I can't sign till they came down so anyway we woked me and my wife we let them in.
they said the reason we are here you didn't report. I said when was my reporting and when did you send me a letter for reporting?they have no answer. I show them my new application post office receipt and my reporting was on the 3rd of April but I received a text by 17th of March to report on 19th of March and then I been detained by the same office the one came today luckily.i said to them then I was released on 28th of April and went for screening interview why they didn't detain me if I missed the reporting? then they talk to someone on the phone and said now we forgot to bring some documents but we will send you on the post.
I am so glad they didn't take me otherwise it was gonna broken down my wife my dog my mother an law and all my family.
she said you never been overstayer or abscond that's ok.
the new application I sent on the 15th of October. I did not receive anything yet.
don't know why they came what was the reason but I think they wanted to check me we living together or now.

Hi guys

I'm a UK citizen. I am wanting to get married to my partner who's a refused asylum seeker, he's been in the UK for almost 8 years I am disabled and also claiming benefits such as PIP and universal credit. Could you please give me some advice on what is the best route for him to settle in the UK as my spouse and what the requirements would be.

Hi everyone have been a silent reader for months. My son is turned 3 years old last month and got his British passport in July. My partner has permanent residence (family member of union citizen). I have been visiting the UK since 2013 and dating my partner. She found out she was pregnant early 2015 so I went back home and came back 4montys before our son was born, I was on a 2year visitor visa and since then I have overstayed. My visiting expired in September 2016. My partner got permanent in February 2018 so we naturalised our son and got his British passport.

I don’t have much evidence of cohabitation as I arrived as a visitor but my wife earns over £20k and recently applied for universal credit. I take care of our son full time while she’s working.
We got enganged and did a traditional marriage(not registered) before the baby was born and we have lots of pics.

I am about to apply to regularise under flr but my lawyer says it will be based on human right. Pls is this correct and what are my chances?
What evidence should we provide?
Only my partners name is on tenancy of agreement which is dated 5 months ago. We were living with her family before we got our place.

I think you should go to a good barrister or solicitor they can advise better.
But if you got a kid from British citizen I don’t think it will be that hard now for you to get a visa

Ok thanks but my partner isn’t British, she’s is non eea with permanent residence similar to ILR and my son just got his British passport. The solicitor says flr human rights outside the rules because I was a visitor pls is this correct?

What other way can you apply? You'll need to try FLR (FP) or voluntarily leave the UK and get the Partner to sponsor you from your country. But if she is on universal credit she will probably not be working right now.

Ok but she is working still on £20k, I take care of our son full time.

Adenet, Your lawyer is right, you’re most likely going to get your visa based on human right and will be decided outside the rules because your child is British and it will be unreasonable to tell you to leave as it will breach human right law..... I had slightly similar case and I got my visa... I pray it all works out for everyone waiting
