Apologies that this isn't a timeline update but I'm hoping someone in this thread will help me with my query. My residency permit expires in early June and I'm preparing my final renewal but just found out about the early irl concession.

Background:

- Came in the UK under a visitor visa at age 10 (I'm now 29)
- Mother is British. Father doesn't live in the country
- Overstayed the visitor visa before applying for anything else
- Had several attempts to get a legal stay refused between 2005-2013
- Granted 10 year private life route in 2014 (20 years old at the time)
- successfully renewed subsequent visa and last renewal was granted in 2020 prior to the concession


My question is do You think I'll be able to be granted early ilr?
Like most people this experience has been daunting for me over the years and I can't afford a solicitor at this time. But do not want to jeopardise my application or make it more complicated - My case has always been regarded as complex by the HO and I can't use the premium service etc.

I have the forms and documents ready for the flr(fp). Will a simple statement in my cover letter asking for the case to be considered for early ilr under the concession be sufficient. I don't want to change routes or use any other forms as I'm worried I'll apply for the wrong thing.

I was in almost the same position as you have described. Thanks to the early ILR concessions I have managed to obtain ILR under this route after having completed 7 years under Private Life (Half life route).

Prior to June 2022, the guidance was to renew your leave to remain and request that you wish to be granted Early ILR in line with the concession. However, since June 2022, there has been a dedicated application process for ILR after 5 years Leave under Private Life (Half Life and under 18s).

I have attached the guidance below.

You would need to book and pass the Life in the UK exam (at additional cost) prior to submitting your application.

According to the guidance you don't need to provide an English language certificate, however, I personally did sit an approved B1 English exam just as a precaution.

We undate tomorrow.
P.s I'm trying to switch to 5yr route as I fulfil all the requirements hubby earn 32 grand and I passed my English exam. Fingers cross
UPDATE went to the post office early this morning I was granted 30 months 5yr partner route. Awaiting my brp.

I have been granted a 2.5 yrs visa in Feb 2021 after a long case to prove that I and my partner are in a genuine relationship. I and my partner been together since 2011, but not married and don't have children. I am on 10 yrs route and due to extend for the first time after initial grant. I would like to switch to the 5 yrs route. You mentioned that you have switch to FLR(M) by filling application FLR(FP). I have the income and English language requirements. Can you please elaborate on how to do the application FLR(FP) for switching to FLR(M)? I have also red in the FLR(M) guidance notes the following;

You must not use this form to make an application for an extension of stay in the following
categories:
• As the partner of a serving member of HM Armed Forces under Appendix Armed Forces of the
Immigration Rules. You must complete form FLR(AF).
• On the 10 year Partner route under Appendix FM of the Immigration Rules. You must complete
form FLR(FP)



Would you please help me to understand which application should I send for switching to 5 years route and basically whether actually i am eligible to do so knowing that we are unmarried partners?

My fee waiver took 34 working days to get a decision. I applied on April 2nd and was granted on May 19th. Most fee waivers are decided between 6-12 weeks. Hang in there, you will hear back soon.

Here's my timeline for anyone that is looking to make an application. And yes, I used the FLR M form cause EX1 applies. I met all the requirements but one (no valid leave), so I used FLR M form because why not.

First of all, I was an overstayer (7 years 6 months), lived in UK 11 years in total, came on a student visa. I declined to use a solicitor and proceeded to do it myself, of course, I read up on it extensively to make sure that I get it right and luckily I did.


Solicitor used: No
Fee waiver application submission: 2nd April 2023
Further evidence: 18th May 2023
Fee waiver granted including IHS: 19th May 2023 (35 working days)
FLR (M) submitted: 22nd May 2023 (standard)
Biometrics: 3rd June 2023 (free)
Additional evidence: None
Decision email (granted): 6th July 2023 (24 working days) from biometrics....on the 10 year route but I'll be applying in the coming days to switch to the 5 year route, now that I have met all the conditions.
BRP: Waiting
Passport: Waiting

My application wasn't the most straightforward as a result of my overstaying, but besides that, I met all other requirements but that plus it also helps when you have no criminal record or owe debt to the NHS.
Obviously, I still had to show why I should be granted LTR, which I was able to prove that a refusal would result in very harsh consequences. Having a child on the way certainly helps

It is fair to say that I have been pretty fortunate with the processing time.

If anyone has any question, I am happy to answer.

1. Please do not attempt to change the heading of this topic to FLR M.

2. if you have been granted a visa on the 10 year route, it is FLR FP and NOT FLR M route. They are two completely different sets of immigration rules.
