overstaying fiance of tier 2 visa holder

Post by patrick112345 » Sun Mar 05, 2017 10:04 pm

just need some advise on what to do regarding my situation.

-i overstayed in the uk originally with a visit visa 2.5yrs ago
-my fiance came last january2016 to the uk with a tier 2 visa
-we have been together since 2009 with proofs (photos, bank acct)
-we are planning to get married soon

?is it a good idea to get married here or in my home country?
?if we get married here, is there a chance to get a dependent visa applying in-country?
?if we get married in our home country will i be given visa as dependent?
considering i overstayed.

thank you in advance

?is it a good idea to get married here or in my home country?
Highly unlikely that you will be able to marry here. You are required to give 28 days notice to an HO approved Registry. This notice period can be extended to 70 days for HO to investigate and/or interview each of you separately. High risk of you being detained by HO due to your overstay.
?if we get married here, is there a chance to get a dependent visa applying in-country?
No, not if you do not have valid leave. You will have to apply from your home country. Re marrying, see my comment above.
?if we get married in our home country will i be given visa as dependent?
considering i overstayed.
Maybe, probably a chance of refusal due to your overstaying and 'frustrating the immigration rules'.

Under a tier 2 dependent visa there are no options. You could even be refused after you get married in your home country. I would expect a very high chance of refusal given your circumstances.
The only route that would be more in your favour than not would be a spouse visa and you would only qualify if your partner has ILR.
