Given 4 months leave on visa for a course under 12 months

Post by poling213 » Thu Mar 09, 2017 2:14 am

Hi all, asking for a friend here.

We were told that Tier 4 visas for courses under 12 months will mean that you will be given only 2 months extra once this course ends.

My friend started a legal conversion course in January - the course lasts from January to September 2017 (9 months). But her Tier 4 lasts until the end of January 2018. Is this a mistake on the HO's past? Does she need to do anything.

Yes.

Yes. See the Tier 4 Policy Guidance, page 14:

You must also notify the Home Office if there is an error on your visa – for instance that the period of
leave is incorrect or it includes a right to work and you are not entitled to work

Thank you.

Would it be deception if she reports this now, given that she has already started the course? Can her visa be taken away and her being deported by any chance?

She has to do her LPC after graduating from the GDL. If she doesn't report this, will the HO find out about this error and then not grant her an LPC? Given that she doesn't know about the 2 month vs 4 month leave rule.

No.

She knows now. Why take such risks when the guidance says she needs to let them know?

Technically, I haven't told her yet, so she doesn't know. Would this mean that if she doesn't report this to the HO and stays till the end of her visa as stated in her BRP (ie. Jan 2018), the HO would count that as overstaying when she applies for a new visa from within the UK in December for her LPC that starts in January 2018? Or would the HO just ignore this and just allow her to apply from within the UK?

Hey there,

I've been browsing around for information about correcting errors. I keep coming across this line on university websites:

"Contact us as soon as you notice an error on your visa as there is a limited period of time in which the UVKI will agree to correct the errors."

What is this limited period of time? When does this limited period of time end, and where can I find this information?

Send your friend to the international student adviser at the university, and they will help her sort it out.
