Hi All,

I am currently on Tier 1 and would like to apply for ILR. However, in year 2/3 of the 5 years, I have spent circa 420 days outside the UK and hence breaking the 180 day rule. While being away, I was working for the same company, while physically based in the Group's overseas office. I continued to be on UK payroll and was paying NI.

I had given up on getting ILR and instead went for Tier 1 extension. However, looking at few cases on the portal it seems that many cases have been successful and I was hoping to hear from any recent applications with similar circumstances. Are the case workers willing to allow the leave in light of the applicant being tax domiciled in the UK for the same period?

In addition to the employer's letter, confirmation of payment in the UK, what else should I include which might help my case.

Would appreciate your reply/thoughts.

You have a gap that is unacceptable for 5 year ILR.
Also I am not sure how you are planning to extend your Tier 1 General as that is not allowed any more
