Tier 2 ICT to T2 General - Sorry if it is repeat

Post by Dilliwalah » Tue Mar 21, 2017 10:20 am

Hi All

Q.1
I was issued T2 ICT on 6/5/2010 first but my COS was issued on 19/03/2010. My work start date mentioned on COS was 05/04/2010.
Can someone please help understand if the COS or work date can be taken into account. As my T2 ICT start date was after the rule changes.
If COS or work date are taken into account then am I eligible for ILR now?

Q.2
I switched to T2G from T2ICT in March 2015 will it mean I can apply for ILR in March 2020?

Q.3
In 2020 shall i apply for 5 year T2G route ILR or 10 yr Long residency ILR?

Thanks for your patience and time to answer these questions.

When was the application fee paid?
Going by what I've heard from a senior member its the application fee date that matters while deciding pre or post 6th April rules

See below link for a similar case

I am not totally sure of that and need to find out. It would be the date of the interview with vfs when the application paid fee would have been considered.

So it is the application date of the visa application and not any date on the COS?

Thanks for your response.

No it is not the date of the CoS, it is the date you paid the fee that determines when you applied.

You need to find when the application fee was paid to understand when you are eligible

Q.3

Up to you. If you have dependents, you can include them in your application if it was an ILR on a 5 year PBS route. For LR, i think your dependents will need separate applications and they need to satisfy the LR eligibility criteria.
