Hi

I am an Irish citizen, so is my wife, although she is a citizen of a south American country. She would like to bring her mother to Ireland permanently. From what I understand these types of applications are stringently examined by Justice and we are unlikely to succeed.

A friend of a friend of my wife's apparently applied to bring her mother to Ireland but was refused. One of the reasons why she was refused was apparently because her mother was over 62. This seems like an arbitrary number but I guess they have to draw the line somewhere. Can anyone confirm that Justice automatically refuse long term visa applications for anyone over 62? I can't see any reference to a specific age in the Non EEA policy document that they published in Dec 2016

Hi there,

It is likely your friend's friend mother's application was refused because their case was considered under Irish domestic law rather than her age. The domestic Irish law would make bringing family member over on a permanent basis very difficult. Hence most of us have taken the painful route of relocating to another EU country in order to exercise Treaty Rights

So in your case it means relocating to another EU country and apply from there for a residence card

Thanks for the reply. That's what I feared. Our "Plan B" was to move to the UK for a year and bring her mother there, then return to Ireland using the Surrinder Singh route but now that they want out of the EU, this has thrown a spanner in the works. We might consider Spain instead, as we both speak Spanish (although my Spanish could use some work :oops: )
