7.1 Considering further DL applications wrote:...
Out of time applications must still be considered on the basis of all the evidence put forward and the fact that the application was late should not, on its own, be used as a reason to refuse further leave where the individual otherwise qualifies under the policy. Those who apply out of time will be unable to accrue continuous leave towards settlement.

Thanks for info. My expired dlr was granted based on my kids from previous marriage, however now I am with someone else who has 4 kids for me, and they all have indefinite leave to remain thru Asylum as my partner is from Zimbabwe. She is on single mother benefits and I stay with them but compliance has discovered. What do you advice I do please.

Are you still in close contact with your children from the previous marriage on which the DL was granted?

Perhaps apply on the basis of all your children?

Thanks again. I am in contact with one of them, the other does not want to be in touch as blames me for marriage break up. My current position is 4 kids( 10yrs, 9yrs, 5yrs, 2yrs respectively) unemployed, as it stands I cannot give my partners address as where I live due she is on benefits, how does this look. It's eating me up, reason for overstay on visa as always been my inability to raise the funds for the process. What advice can anyone give. Am really worried.
