EEA PR (family member): do I have to provide 5yrs activity?

Post by BRENTER2019 » Thu Mar 30, 2017 3:20 pm

Hi everyone,

I am a Dutch citizen who has lived in the UK since 1999, I came here as a kid, and a few years ago my parents successfully applied for PR but they did not bother to do it for me (for whatever reason).

I'm now over 21 but I can't apply without a sponsor because I did not have "comprehensive sickness insurance" during my studies here. I am now trying to apply by having one of my parents as a sponsor so here is the question:

In section 9.1 it says "If you’re applying as the family member or extended family member of the relevant EEA national named in section 2, or because you have retained your right of residence, does the
relevant EEA national have a document certifying permanent residence?"

I have answered YES because my sponsor (one of my parents) already had permanent residence therefore I am told to skip section 9 now (the Relevant EEA national’s activity in the UK section). Do I have to provide my own activity for the last 5 years in this section?

No, you do not, as you are not applying based on your exercise of EEA rights, but your parents'. So, it is those rights you need to demonstrate.

Thank you! It's really unclear on this, is there anywhere this is stated clearly?

Also, does providing one of my parents PR card all that is needed to demonstrate that they were exercising treating rights? It seems too simple that all the documentation I have to provide seems to be the PR card regarding UK activity.
