Spouse of EEA with refugee leave can apply for EEA(PR)?

I am an EEA resident in UK with Permanent Residence certificate, EEA(PR). My spouse, since 2014 has been on a 5-year refugee leave to remain visa. In 2015 we got married and since then we live in the UK.

Can the spouse apply for EEA(PR) permanent resident card after 5 years of marriage, despite being on refugee leave?

I ask this, in case the refugee settlement SET(P) fails by whatever reasoning by HO through the Safe Return Review, recently implemented for refugee settlement.

Of course I assume that the EEA spouse does not naturalise to become British citizen.
