My husband came to the uk in October 2011and received his eea permit in august 2012. He got a job straight anc is been continuously working since then. I thought you have a right if residence after five years and in october 2016 he completed the five years. Or is it required to apply for PR a month before the eea permit expires?
Assuming that you were married when he arrived in Oct 2011, and assuming that you have exercised treaty rights for the five years since Oct 2011 (or have PR yourself), and assuming that he was not out of the country more than six months in any twelve month period, then your husband acquired permanent residence in Oct 2016. He can apply any time he wants for confirmation of this status, which is the EEA Permanent Residence card. There is no requirement to wait for the current EEA Residence Card to expire. Under the EEA rules you can apply for confirmation of a right as soon as the right is acquired.
