Tier 1 Dependants first application (outside UK) documents

Post by Camel555 » Fri Apr 14, 2017 1:56 pm

Dear All,
Apologies if this has been answered before, would appreciate your comments/advice on my scenario:
I have recently been given Tier 1 E visa and am now in process of transferring funds, winding up my existing business in my home country etc. I am planning on applying for my wife and two children with the latest possible intended date of arrival, which is 3 months I think, and after lot of guidelines readings and searches, have come to the following documents list:

1. Main applicants' (myself) BRP copy
2. Bank statements showing availability of maintenance funds for 90 consecutive days including funds for myself and not counting the original funds I showed for investment
3. Dependants' applications, passports, pictures, marriage certificate, birth certificates of children
4. TB tests for all ( not sure about children TB test)
5. Criminal record certificate for 18s and above ( I think children don't need it)

Guys pls tell if I am missing out on anything, in policy guidelines, it has been precisely mentioned that no other evidence needs to be provided, so, in my case, I don't have to write sponsor letter etc or letting agreements etc as my initial leave to stay was granted just a couple of months ago, Is it correct?

Secondly, do dependants have to be present in the UK for 180 days/year? I know to qualify for ILR, one must have spent 180 days per year for 5 years, but unlike the main applicant who cant stay out of UK for more than 180days/year or else his/her visa will be curtailed or renewal refused, would this restriction apply on dependants as well.

My point is, if my dependants apply today 14th April, mention the intended date of travel as 14th July (maximum 3 months allowed), travel to UK to collect BRP after 14th of July, get back to home country after collecting BRP and then DO NOT travel back to UK for next 6-7 months, then in this case would they be in legal limits, apart from making up for this lost time in later years to qualify for ILR.

Thank you in advance

It seems fine. You need to pay IHS surcharge too.

The continuous stay requirement does not apply to dependants of PBS migrants as per latest rule changes

No one is restricting your dependants to remain in the UK
