Switching from Tier 1 General to Tier 2 General

Hi there,

I was wandering if some experts can help me please. I am waiting for my ILR for the past 10 months now because of the tax-discrepancy issue and don't know how long it is going to take as it's with everyone who are waiting.I just need to travel urgently. Is it possible to switch my application from Tier 1 General to Tier 2 General if my company sponsors me or would it be any problem doing so because of tax discrepancy?

Your help would be highly appreciated.

Your post isn't relevant to the ILR sub forum. But before I move it, how long have you been employed with your employer? When did your Tier 1 G expire? Is your employer an HO approved Tier 2 sponsor??

Sorry about posting on the wrong forum and thanks for replying.

I have been working with my current employer for 2 years now and my Tier 1G expired in June- 2016 and its been 10 months now since I applied for my ILR. My employer doesn't hold a sponsor ship license at the moment but they can certainly apply for one if they need to.

It takes a couple of months, sometimes a bit longer, to get a sponsor license.

Your employer will also have to do the full and proper RLMT process before they can issue a CoS to you, to prove to HO that you have NOT been 'pre selected', and this is where the difficult will be given that you have worked for them for 2 years.

You also have an expired visa, so not sure if you could apply for Tier 2 General. The minute you withdraw your ILR application, your section 3C cover ends and you will be an overstayer from the date your Tier 1 G expired.

Switching implies you have a valid visa, which you do not as your Tier 1 G has already expired.

For the RLMT, if your employer can get a sponsor license, will be heavily scrutinised to determine why you are the only available to do the job and not any other person with ILR/BC or EU citizenship (and these only have to be suitable, not match EVERY criteria). Your employer also cannot make the RLMT so difficult and so tailored around you that it excludes anyone else.

Added to this the fact that you have an existing ILR application (or withdrawn), following Tier 1 G with tax discrepancies, you can certainly expect a delay in issuing a Tier 2 General visa.

Make sense! Thanks for the help. Can you please help with the below as well.

As you know I have been waiting for my ILR for 10 months now and my wife wants to visit her parents. Is it possible to invite her parents, brother, cousin and my mother while we are still waiting for our ILR?

They want to come on different dates anyways and we rent a 3 bedroom house.

Should we apply for them separately, I mean separately for my mother and then for her parents, brother and cousin or we can apply together for all of them?

Tourist visa

Hi there,

I know it's not the right place to post this question but don't know where to ask.

I have applied tourist visa for my mother in law this week and by mistake we have put surname in the first name and first name in the surname in the application form. Have emailed on UK Visas and Immigration to let them know but don't know if it would affect the case result?
