ILR and Child born in UK - Query

Hello,

I am applying for my ILR in June'17. My Spouse ILR application submission would be delayed due to document gathering delays.
Child is born in UK, and is 2 year old.

Can you pls check on my few queries:

• 1) What is UK born child's ILR/naturalisation process?
  2) If both parents have ILR approved, should I apply for child's ILR as well, or I can apply for child's British passport directly?
  3) If only one of parent's ILR is done, and other parent's delayed, then what need to be done for child's ILR or British passport?
  4) Can Spouse ILR application be done separately later? If yes, will it involve any special steps/forms?

1) What is UK born child's ILR/naturalisation process?

Once either parent has ILR, you can REGISTER the child as British under section 1(3) of the nationality act. ILR is NOT required

2) If both parents have ILR approved, should I apply for child's ILR as well, or I can apply for child's British passport directly?

Only a British Citizen can apply for a British passport. Your child is NOT a British citizen yet. You will have to register the child on form MN1 first.

3) If only one of parent's ILR is done, and other parent's delayed, then what need to be done for child's ILR or British passport?

Only ONE parent needs ILR if the child is UK born to be able to register the child as British.

4) Can Spouse ILR application be done separately later? If yes, will it involve any special steps/forms?

Yes. Set(O) form, same as yours.
