Tier 2 Dependent Visa Work Restriction

Hi,

My dad is currently working abroad due to his job type (oil & gas) and is the dependent of my mother, who is the main Tier 2 visa holder and has a permanent job in the UK. Reading through these forums, I have not come to a definite answer as to whether there are any working restrictions for the DEPENDENTS if they are working abroad? He has been working there for over a year, and I have read something about a 180 days absence and he is already a couple of days over that this year. It would be last resort to come back to UK due to the bad jobs situation in his sector so he wishes to work abroad till it improves.

If anyone can let me know if him working abroad (he still visits 4-5 times a year for probably a total of 2-3 months) will affect his ability to get an extension when the main applicant (my mom) applies for an extension, as well as getting the ILR ultimately.

Any help would be appreciated.

Assuming your dad's initial application was from 9th July 2012, he requires continuous leave of at least 5 years for ILR, where absences are permitted. They had recently imposed but subsequently removed the 180 days restriction on the dependants' absence periods outside the UK.

However, if parents are spending times apart, then they should also show subsisting marriage, etc.
